Professor Alvin Padilla-Babilonia, in his Michigan Law Review article The Imposition of Constitutional Rights, argues that citizens in U.S. territories should decide for themselves how constitutional rights apply in their communities, rather than having outside courts impose uniform rules. He shows how these jurisdictions could discover new ways to handle significant issues like jury trials, free speech, campaign finance, and gun control in ways that reflect their own values, thus reconciling constitutional rights with other democratic values.
